The regional newspaper "Weser-Kurier" initially reported on the unauthorized deployment of a surveillance system at an elementary school that spanned over several years. Parents were shocked to discover the clandestine CCTV, which lacked any warning signs or relevant information. A father approached the school administration, the education office, and the state data protection office in 2023, prompting an investigation. The data protection authorities concluded that the CCTV usage breached the law.

According to the State Data Protection Commissioner, the prerequisites for CCTV installations, such as those employed to prevent vandalism, were not met. Additionally, the school failed to provide appropriate information about the cameras and lacked safeguards to secure the recordings from unauthorized access. The main entrance, playground entrance, and rear entrance were monitored by the cameras. These devices were active during school hours, live footage only being transmitted. Recordings were made between 4:00 PM and 7:00 AM the following morning. "Recordings were stored for 72 hours to prevent vandalism and then overwritten," Utermark disclosed. Both the school administration and janitor's office had access to the images from the system. Post intervention, the devices were shut off and removed.

System Installation in 1999

The education office spokesperson informed dpa that the system was installed more than 25 years ago on the request of the then-school principal or janitor during a renovation. "The installation was not coordinated with our office." The data carriers were handed over to the authority to ensure compliant data disposal.

According to the education department, cameras in schools can be used for specific purposes, like deterring or investigating criminal offenses and vandalism, subject to certain conditions. Surveillance is generally restricted to school hours, except in exceptional cases.
